Terms of Service

These Terms of Service ("Terms") govern your use of the Dinner2Night iOS application and related services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The service

Dinner2Night is an AI-assisted household kitchen application. It helps you track grocery inventory, manage shopping lists, get meal suggestions, and share that context across the members of a household. The Service is provided "as is" and we may add, change, or remove features at any time.

2. Eligibility and accounts

You must be at least 13 years old to use the Service. You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us promptly if you suspect unauthorized access.

3. Acceptable use

You agree not to:

• Use the Service for any illegal purpose or in violation of any law.
• Upload content you do not have the right to upload, including images of other people without their consent.
• Attempt to reverse engineer, decompile, or otherwise tamper with the Service, except to the limited extent permitted by applicable law.
• Use automated systems to access the Service in a way that places undue load on our infrastructure.
• Use the Service to generate content that is harassing, defamatory, or otherwise harmful.

4. AI output

The Service uses third-party AI models (currently Anthropic's Claude) to parse photos, identify pantry items, and generate meal suggestions. AI output can be incorrect or incomplete. You are responsible for verifying anything that matters before acting on it — especially anything related to food safety, allergens, dietary restrictions, expiration dates, or quantities. Do not rely on the Service as a substitute for medical, nutritional, or professional advice.

5. Your content

You retain ownership of the photos, lists, and other content you upload ("Your Content"). You grant Dinner2Night a limited, worldwide, non-exclusive license to host, process, and display Your Content for the purpose of operating the Service for you and the other members of your household. We do not use Your Content to train AI models, and we do not sell Your Content.

6. Household sharing

When you join a household, your contributions become visible to other members of that household. When you invite someone to a household, you confirm that you have the right to share that household's data with them. We are not responsible for disputes between household members.

7. Subscriptions and billing

Parts of the Service may be offered on a paid basis. If you purchase a subscription, billing is handled by Apple through your App Store account, subject to Apple's terms. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. Manage or cancel subscriptions in your Apple ID account settings.

8. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if continued provision of the Service to you would expose us to legal liability. Sections that by their nature should survive termination (including ownership, disclaimers, limitations of liability) will survive.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DINNER2NIGHT AND ITS CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM AND (B) USD $50.

11. Indemnification

You agree to indemnify and hold Dinner2Night harmless from any claim arising out of your violation of these Terms, your misuse of the Service, or your violation of any third-party rights.

12. Changes to these terms

We may update these Terms from time to time. When we do, we'll update the "Last updated" date above and, for material changes, notify you in the app. Continued use after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.

14. Apple-required terms

You acknowledge that these Terms are between you and Dinner2Night, not Apple, and Apple is not responsible for the Service or its content. Apple is, however, a third-party beneficiary of these Terms and may enforce them against you. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Service.
